Is Georgia a No-Fault State for Car Accidents?

No. Georgia is not a no-fault state for car accidents. In no-fault states, car accident victims turn to their own insurance for compensation for their medical expenses and lost wages. In Georgia, the at-fault driver is responsible for paying for the damages they cause.

All motorists in Georgia are required to maintain minimum liability insurance to pay for damages they cause to other road users due to their negligence in the following amounts:

  • $25,000 in bodily injury per person
  • $50,000 in bodily injury per accident
  • $25,000 in property damage

Our Columbus car accident lawyers can fight for the compensation you deserve. If you lost a loved one in a car accident claim, you can seek compensation for your pain and suffering with the help of our wrongful death attorneys in Columbus, GA.

Types of Vehicle Accident Cases We Handle in Columbus, Georgia

Every vehicle accident is different, and each one calls for a unique approach to insurance, evidence, and recovery. Our team has experience handling a wide range of accident cases throughout Georgia.

Crashes Involving Multiple Cars

Chain reaction wrecks can quickly get complicated when several vehicles are involved. Sorting out which drivers or insurance companies are responsible takes careful investigation and attention to detail.

Rear-End Collisions

A rear-end collision occurs when one vehicle crashes into the back of another. Sudden stops, distracted driving, and following too closely are common causes. Although these crashes might seem minor at first, they can lead to injuries like whiplash, back pain, or even more serious problems that show up later.

Head-On Accidents

Head-on accidents take place when two cars collide front-to-front, usually while traveling in opposite directions. These crashes tend to cause severe injuries because high speeds are often involved.

Truck and Commercial Vehicle Collisions

When a large truck or commercial vehicle is involved, injuries and property damage often increase. These cases bring extra challenges with federal trucking regulations and multiple companies that may share responsibility for what happened. Call our experienced truck accident lawyer in Columbus for a free consultation today.

Motorcycle Accidents

Motorcycle crashes often leave riders with serious injuries. Visibility issues, road hazards, or careless drivers are just a few reasons these accidents occur.

Single Vehicle Accidents

Not every vehicle accident involves another driver. Sometimes poor road conditions, vehicle defects, or unexpected obstacles lead to single-car crashes. Even when only one car is involved, there may still be grounds for a personal injury claim.

We take on these and many other types of accident cases in Georgia. No matter what type of vehicle accident you were in, such as a Columbus Uber accident, we can help.

Common Causes of Car Accidents

Securing compensation for your car accident depends on proving the other driver was at fault. Common causes of car accidents in Columbus include:

  • Speeding
  • Drinking and driving
  • Inattention
  • Distracted driving
  • Failing to yield the right-of-way
  • Following too closely
  • Disobeying traffic signals or signs

Our Columbus personal injury lawyer works to gather evidence to establish that the other driver was at fault and to determine the full impact the injuries had on your life. If you lost a loved one in a tragic vehicle accident, our proven Columbus wrongful death attorney can help.

What Should I Do After a Car Accident in Columbus?

You can take specific steps to protect your rights and preserve your future legal claims. Here is a short list of steps to take after a car accident:

Get to Safety

The most important thing is your health and safety. Pull your vehicle over to the nearest safe location. Check yourself and your passengers for injuries.

Report the Accident

Call 911 to report the accident. Request an ambulance if anyone is injured. If law enforcement responds, be polite and give them factual information. Don’t take the blame for the car crash or give an opinion about how the accident happened.

Gather Information

Ask the other driver for their name, contact information, vehicle information, and insurance information. If any witnesses were present, ask for their names and contact information, too. Take pictures and videos of the accident scene.

Seek Medical Attention

Follow up with your medical treatment after the accident. Keep all your medical records and follow your doctor’s advice regarding limitations.

Keep All of Your Accident-Related Documentation

You may begin accumulating various pieces of evidence and documentation. Keep this information organized. It may include:

  • The police report
  • Medical records
  • Payroll records
  • Insurance communications
  • Personal journal entries detailing how your injuries have impacted your life
  • Photos and videos of the accident

Provide your Columbus personal injury attorney with this evidence.

What Is the Deadline to File a Car Accident Lawsuit in Georgia?

In Georgia, auto accident victims generally have up to two years after an accident to file a personal injury lawsuit. If you don’t take legal action within this timeframe, any future case you file can be dismissed as untimely.

What if I Am Partially at Fault for the Accident in Columbus, GA?

If you were partially responsible for a car accident in Columbus, Georgia, you might still be able to get compensation for your injuries and other losses. Georgia uses a rule called modified comparative negligence, which affects how much you can recover based on your share of the blame.

You Can Recover Damages if Less Than 50% At-Fault

You can seek money for your damages as long as you are found to be less than 50% at fault for the crash. If the insurance company or a court says you are 50% or more to blame, you cannot collect anything from the other party.

Notwithstanding the provisions of this Code section or any other provisions of law which might be construed to the contrary, the plaintiff shall not be entitled to receive any damages if the plaintiff is 50 percent or more responsible for the injury or damages claimed.

Reduced Compensation Based on Fault

If you are assigned some of the blame – say 20% – the amount you collect will be reduced by that same percentage.

Where an action is brought against one or more persons for injury to person or property and the plaintiff is to some degree responsible for the injury or damages claimed, the trier of fact, in its determination of the total amount of damages to be awarded, if any, shall determine the percentage of fault of the plaintiff and the judge shall reduce the amount of damages otherwise awarded to the plaintiff in proportion to his or her percentage of fault.

For example, if your total damages are $10,000 and you were 20% at fault, you would still be able to recover $8,000.
